1. Who We Are
The online store at portionplate.eu is operated by Jūlija Šteinberga (individual trader), Latvia. Contact: julija@portionplate.eu.
2. Scope
These Terms apply to all orders placed through portionplate.eu by consumers within the European Union. By placing an order you confirm that you are at least 18 years old and accept these Terms.
3. Products
We sell porcelain portion-control plates and related accessories. Product images are illustrative; minor variations in colour and finish may occur. The plate is a tool to support portion awareness and balanced-eating habits. It is not a medical device and makes no medical or weight-loss treatment claims.
4. Prices
All prices are shown in euro (EUR). Prices do not include VAT, as the seller is currently below the VAT-registration threshold; no VAT is added at checkout. Shipping costs are shown separately before you confirm your order.
5. How a Contract Is Formed
Presentation of products in the store is an invitation to order, not a binding offer. You place a binding offer by completing checkout and clicking the order/pay button. The contract is concluded when we send you an order confirmation by email. We reserve the right to decline an order (e.g. if a product is unavailable), in which case any payment is refunded.
6. Payment
We accept the payment methods shown at checkout (e.g. card payments via Stripe and PayPal). Payment is processed by the respective provider under their own terms. Goods are dispatched after payment is received.
7. Delivery
We deliver to addresses within the EU member states listed at checkout. Delivery times and costs are shown before order confirmation and detailed in our Shipping & Delivery policy. Risk of loss or damage passes to you when you (or a carrier chosen by you) take possession of the goods.
8. Right of Withdrawal
As a consumer you have a statutory right to withdraw from your purchase within 14 days without giving a reason. Full details and the model withdrawal form are set out in our separate Right of Withdrawal notice.
9. Warranty / Conformity
Statutory rights regarding the conformity of goods apply. If an item arrives damaged or faulty, contact us at julija@portionplate.eu and we will arrange a replacement or refund. Please report breakage in transit within 14 days of delivery, with a photo where possible.
10. Liability
We are liable without limitation for damages caused intentionally or by gross negligence, and for injury to life, body or health. For ordinary negligence we are liable only for breach of essential contractual obligations and limited to foreseeable damage typical of this type of contract. Mandatory statutory liability (including under product-liability law) is unaffected.
11. Dispute Resolution
The EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr. We are not obliged to and do not generally participate in dispute-resolution proceedings before a consumer arbitration board.
12. Governing Law
These Terms are governed by the law of the Republic of Latvia, without prejudice to the mandatory consumer-protection provisions of the country in which you, as a consumer, have your habitual residence.
